These General Terms and Conditions apply to customers outside Finland.
1. Registration and Use of Web shop
1.1. Placing an order at the web shop of By Pia’s Oy (”BYPIAS”) does not require registration with the Customer Register. BYPIAS collects only the required data to implement your order.
1.2. In connection with an order or otherwise, a customer can register with BYPIAS Customer Register, in connection with which the customer agrees to include his/her personal data in BYPIAS Customer Register. This simplifies processing customer’s further orders and allows customer to follow his/her orders made after such registration.
1.3. The customer can also register with BYPIAS VIP Customer Register by expressly providing his/her consent to receive newsletters and information on offers to his/her email. The customer thereby agrees that BYPIAS collects the necessary contact information to its VIP Customer Register.
1.4. When using the web service or web shop as well as when registering with BYPIAS Customer Registers you agree to
1.4.1. Use the web service and web shop in accordance with these General Terms & Conditions;
1.4.3. Observe express diligence and caution when using the web shop;
1.4.4. Provide truthful information about you as well to change this information when necessary;
1.4.5. Obtain the consent of your guardian for your purchase in the event you are under 18 year’s old;
1.4.6. Keep your username and password secret, not to give them to third parties as well as to be responsible in the event someone else uses your username and/or password in our web shop; and
1.4.7. Immediately inform BYPIAS in the event your username and/or password have come into the knowledge of a third party, in which case BYPIAS reserves the right to immediately remove your username and password from use.
2. Validity of Order
2.1. You can easily place orders to our web shop 24 hours per day. Products are ordered by placing them in the shopping cart. Follow the instructions provided by the web shop in order to complete your order. The order confirmation page shows the aggregate payable amount inclusive all taxes and delivery costs.
2.2. A binding Contract of Sales becomes valid when BYPIAS has sent you an order confirmation by email. Thereafter BYPIAS does not have the right to change the terms applicable to your order.
2.3. A consumer has the right to, partly or fully, cancel the order prior to its delivery by email, letter or telephone. Delivery has taken place when the consumer has received the ordered products or a notification confirming that the ordered products can be collected from the post office.
2.4. BYPIAS and the customer keep contact either by using email, letter or telephone. Our professional personnel is happy to help our customers on weekdays between 9 a.m. and 4 p.m. (GMT +2) in all inquiries as well as in all matters relating to orders. 3.1. All prices in our web shop are inclusive value added tax (VAT 24%). The prices in our web shop are shown in euros (EUR). Offer prices have been marked clearly and separately per product.
3.2. The postage fee to EU countries is EUR 9.90
3.4. When ordering products outside the EU, we kindly ask you to contact our customer service by email at email@example.com or by telephone on weekdays between 9 a.m. and 4 p.m. (GMT +2) at our Customer Service number +358 50 361 4232.
3.5. Customers ordering products to be delivered outside the EU are, in addition to the postage fees provided in Section 3.2 above, responsible for any customs or other government fees applicable to their order.
3.6. We reserve the right to cancel an order on the basis of clear errors in pricing. In the event that a product does not have pricing information, the price has been set to EUR 0.00 or the price clearly deviates from its correct price (e.g. EUR 150.00 price has been set to EUR 15.00), the customer should have understood that the pricing information contains an error.
4. Terms of Delivery
4.1. BYPIAS delivers products to Finland, Sweden and other EU countries as well as per separate agreement to countries outside the EU. Delivery times vary between different countries. Please contact our Customer Service for more information.
4.2. As we also sell our products in our stores, the stock information may sometimes be updated with delay. Therefore, even if our web shop shows that a certain product is still in stock, we may, in connection with processing your order, notice that said product has been sold out or has to be ordered form our sewers in our cooperation ateliers.
4.3. In the event a product delivery requires an order from our cooperation ateliers, the estimated delivery time is 2-5 weeks. All custom-made products as well as sizes in excess of XXL require a separate order from our cooperation ateliers.
4.4. Upon receipt of your order, we will inform you whether the desired product is in stock, sold out or whether it needs to be ordered from our cooperation ateliers. The product page in our web shop contains further information in the event the delivery time is estimated to be much longer than provided in Sections 4.1 and 4.3 above. We will also inform on the product page, if the product is sold out, there only is a limited lot of the product available, or if for reasons beyond our control, the delivery will be prolonged. We are not able to respond to continuous interim inquiries on the delivery time or completion of the products.
4.5. In the event a product delivery is required per a certain date, such request must be informed in connection with the order. We will use our best endeavours to fulfil such request, if possible.
4.6. In the event a consumer orders several products with different delivery times, the products will be delivered together in accordance with the longest delivery time, unless otherwise has been specifically agreed.
4.7. BYPIAS is not responsible for any damages or delays which are due to force majeure or similar reasons beyond its control which it could not have reasonably predicted or the consequences of which could not be avoided. Force majeure and similar reasons consists of, but is not limited to the following: import and exports bans, industrial actions, sick leave of personnel, authority decisions, equipment or personnel related problems of cooperation ateliers, delays in fabric deliveries, disruptions in transportation, war, natural disasters, or any other similar reason. In the event the force majeure or similar reason continues for more than three months, both the consumer and BYPIAS have the right to cancel the order/agreement without any damage or other consequences.
5. Payment Terms
5.1. Payment by Visa Electron or Mastercard
5.1.1. Paytrail Oyj (2122839-7) acts as an implementer of the payment handling service and as a Payment Service Provider. Paytrail Oyj will be shown as the recipient in the invoice and Paytrail Oyj will forward the payment to the merchant.

6. Product Change and Return
6.1. In case of product returns concerning products ordered and/or delivered outside the EU countries please contact our Customer service to receive further instructions by either sending an email to firstname.lastname@example.org or by telephone +358 50 361 4232 on weekdays between 9 a.m. and 4 p.m. (GMT+2).
6.2. The Product Return Instructions provided in Sections 6.3-6.6 below are applicable only within EU countries (except in Finland and Sweden which are subject to separate Product Return Instructions).
6.3. It is important for us that you are satisfied with your order. If the product does not meet your expectations, you can, within 14 days from its receipt by mail, change it to another size or colour of the same product category or return it by following the Product Return Instructions.
6.4. The Product Return Instructions are part of these General Terms and Conditions. Observe these Instructions as well the instructions received in connection with your product, in the event you wish to change or return your product.
6.5. You are required to notify of product returns and changes by using the Product Return Form received in connection with the product delivery, attach the completed Product Return Form to the postal package together with the returned products and follow, in addition to these instructions, any additional instructions received in connection with your product delivery. Inform our Customer Service always about product returns and changes by either sending an email to email@example.com or by telephone +358 50 361 4232 on weekdays between 9 a.m. and 4 p.m. (GMT+2).
6.6. In the event the product has been damaged during transportation, please observe carefully the Product Return Instructions.
7.1. It is the obligation of the customer to, forthwith after the receipt of the delivered package, carefully inspect its contents, the condition and amount of the products.
7.2. In the event that a wrong product or a wrong amount of products have been delivered to you or in case your product is defective please contact immediately our Customer service by either sending an email to firstname.lastname@example.org or by telephone +358 50 361 4232 on weekdays between 9 a.m. and 4 p.m. (GMT+2).
7.3. The seller of the product is responsible for any defects in the product in accordance with applicable consumer protections laws. The 14-day time limit mentioned in Section 6.3 above does not limit the right of customer to make claims on the basis of product defects.
7.4. A product is defective e.g. when it is torn or otherwise damaged. A product is not considered to be defective on the basis of normal wear and tear nor if the product has been damaged or has shrunk, because it has not been used and washed in accordance with given instructions. The surface of knitted garments may get frizzed or otherwise uneven, which is part of their natural wear and tear.
7.5. A defective product should be returned in accordance with the Product Return Instructions. After the receipt of the said defective product BYPIAS will either change the product or refund the price of the product.

9. Governing Law and Jurisdiction
The web shop of BYPIAS as well as all related transactions and agreements are governed by the laws of Finland, unless mandatory consumer protection laws of some other country must be applied. All disputes will be resolved at the District Court of Helsinki.
